DANVILLE, Va. — Devin Lamont Womack was found not-guilty of murder by a Danville jury on Tuesday.

The 29-year-old was charged with the shooting death of 47-year-old Mark Anthony Graves on September 30, 2016 at what was described as a “drug house” on Aspen Street.

At the conclusion of his two-day trial, a jury in Danville Circuit Court acquitted Womack on all of the charges, including first-degree murder.

The prosecution contended Womack and two other men shot Graves in an argument over a pack of cigarettes while others continued to drink and smoke crack cocaine as he lay dying in the Danville apartment. Defense attorney Dirk B. Padgett of Roanoke called the prosecution’s witnesses “a bunch of liars” who knew Graves as a drug dealer.

In addition to murder, Womack faced charges of armed robbery and two counts of use a firearm in the commission of a felony. The panel deliberated for almost three hours before finding him not-guilty on all four felony counts.

Womack walked out of the courtroom a free man.
